It also covers technical information collected when you visit our website.
Accepting this Privacy Policy is not the same as consenting to every type of processing. Where consent is required, we ask for it separately, for example in a lead form or through our cookie settings.
3. Personal data we collect
Depending on how you interact with us, we may collect:
- Contact details: name, e-mail address, telephone number and WhatsApp contact details.
- Enquiry details: your message, property or development of interest, intended purpose, approximate budget, preferences and other information you choose to provide.

Please do not provide sensitive personal data unless it is necessary and we have specifically requested it.
4. How we collect personal data
We collect personal data directly from you when you submit a website form, complete a Meta/Facebook Lead Ad, book an appointment, contact us or communicate with our team. Meta sends Lead Ad submissions to our system through its Graph API. We may also collect technical data automatically through server logs, cookies and similar technologies.
5. How and why we use personal data
We may process personal data to:
- receive, record and respond to property enquiries;
- contact you by e-mail, telephone or WhatsApp about your enquiry;
- send confirmation and follow-up e-mails connected with your request;
- allow you to schedule a call and synchronise the appointment with our lead records;
- recommend properties or developments that match the information you provided;
- manage our lead pipeline, prevent duplicate records and maintain an opt-out list;
- operate, secure, troubleshoot and improve our website and services;
- measure website use and advertising performance, and show relevant advertising where permitted; and
- comply with legal obligations and establish, exercise or defend legal claims.
6. Legal bases
Depending on the activity and applicable law, including Thailand's Personal Data Protection Act B.E. 2562 (2019) ("PDPA") and, where applicable, the EU/UK GDPR, we rely on one or more of the following legal bases:
- Steps requested before entering into a contract or performance of a contract, such as responding to a specific property enquiry.
- Consent, including where you consent to marketing or non-essential cookies. You may withdraw consent at any time.
- Legitimate interests, such as managing enquiries, providing relevant follow-up, securing our systems and improving our services, provided those interests are not overridden by your rights.
- Legal obligation, where processing is required by law.
7. E-mail follow-up and opting out
If you submit a property enquiry or Meta Lead Ad, we may send an acknowledgement and follow-up messages related to that enquiry. Every automated lead e-mail contains an unsubscribe link. You may also opt out at any time by e-mailing info@thairealestatepattaya.com.
When you unsubscribe, we stop the relevant automated follow-up and retain the minimum information needed on a suppression list so that we can honour your request. A later, separate enquiry submitted by you may start a new communication relating to that new request.
8. Recipients and service providers
Access within our company is limited to personnel who need the data for their work. We may also disclose or make data available to service providers acting for us or providing services you choose to use, including:
- Meta Platforms for Facebook/Instagram advertising, Lead Ads and related identifiers;
- Cal.com when you use the appointment-booking service;
- WhatsApp / Meta when you choose or request communication through WhatsApp;
- Google for Tag Manager, analytics, advertising and reCAPTCHA;
- Smartlook for website usage analytics and session recording;
- our hosting, database, e-mail delivery, IT support and security providers; and
- professional advisers, public authorities or other parties where required by law or necessary to protect legal rights.
These providers may process technical identifiers and other data according to their own privacy terms. We do not sell personal data.
9. International transfers
Some providers operate internationally, so personal data may be processed outside Thailand or your country of residence. Where required, we use appropriate safeguards or rely on another lawful transfer mechanism. You can contact us for more information about safeguards relevant to your data.
10. Cookies, analytics and advertising
We use necessary cookies for core website functions and optional analytics and marketing technologies to understand website use, improve the site, measure advertising and display relevant advertisements. Technologies used on the website may include Google Tag Manager, Google Analytics, Google Ads, Meta Pixel, Sklik and Smartlook.
You can choose categories of optional cookies and change your choices through the cookie settings available on the website. You can also delete or block cookies in your browser. Blocking necessary cookies may affect website functions. Third-party services may receive technical information such as your IP address, device details, visited pages and cookie or advertising identifiers.
11. Data retention
We keep personal data only for as long as reasonably necessary for the purpose for which it was collected, including managing your enquiry and any resulting business relationship, and to meet legal, accounting, security and dispute-resolution requirements. The retention period depends on the nature of the interaction and applicable obligations.
Lead marketing data is kept until you withdraw consent, object or unsubscribe, or until it is no longer needed. Suppression-list information may be retained longer to ensure that an opt-out continues to be respected. Server logs, analytics records and provider-held data are retained according to operational needs and the relevant provider's settings and policies.
12. Security
We use reasonable technical and organisational safeguards designed to protect personal data against unauthorised access, loss, misuse, alteration or disclosure. No internet transmission or storage system is completely secure, and we cannot guarantee absolute security.
13. Your privacy rights
Subject to applicable law and its conditions or exceptions, you may have the right to:
- request access to and a copy of your personal data;
- request correction of inaccurate or incomplete data;
- request deletion, restriction or cessation of processing;
- object to processing, including direct marketing;
- withdraw consent without affecting processing carried out before withdrawal;
- request data portability where applicable; and
- complain to a competent data protection authority.
To exercise a right, contact info@thairealestatepattaya.com. We may need to verify your identity before acting on a request. We will respond within the period required by applicable law.
In Thailand, you may complain to the Personal Data Protection Committee or its competent office. If the GDPR applies to you, you may also complain to the supervisory authority in your country of residence, place of work or place of the alleged infringement.
14. Children
Our property services are not directed to children, and we do not knowingly collect personal data from children through our lead and enquiry services. If you believe a child has provided us with personal data, please contact us so that we can review and delete it where appropriate.
15. Third-party websites
Our website and communications may contain links to third-party websites or services. Their privacy practices are governed by their own policies, and we encourage you to review them before providing personal data.
16. Changes to this policy
We may update this Privacy Policy when our services, technology or legal obligations change. The current version and its last-updated date will be published on this page.
